On May 23, 2022, officers responded to the report of a person trespassing at a residence on Woodland Rd. The home owner is an elderly resident and due to their mental state, the Montgomery County Office of Aging had been contacted and the Court of Common Pleas, Orphan's Court, has ultimately deemed them a totally incapacitated person. Their court appointed Legal Guardian was assigned as Dr. XXXXXXXXX.
Dr. XXXXXXXXX advised police as of 03/23/2022 that the resident's ex-husband, Robert BRENNAN, was not welcome at the residence. Dr. XXXXXXXXX advised BRENNAN she was the resident's Court Appointed Legal Guardian and Lower Moreland Police have personally communicated to BRENNAN that he was not to go to the resident's home anymore.
As of 03/24/2022 the locks to all the doors were changed because it was believed BRENNAN had a spare key to the home. Lower Moreland Police has been dispatched to the residence after BRENNAN was at the house on multiple occasions.
On 03/30/2022 BRENNAN attempted to gain access to the residence but his key did not work, he proceeded to knock on other doors but access was not permitted.
On 04/01/2022, BRENNAN's vehicle was parked outside the residence unoccupied. BRENNAN was discovered inside the home and he was found locked inside the resident’s bedroom and subsequently arrested for trespassing.
On 04/01/2022 BRENNAN was arraigned and advised by a judge to have no contact with the resident on Woodland Rd and to stay away from the home.
On 05/19/2022 BRENNAN entered the residence again and left the area after being advised by Dr. XXXXXXXXX on the phone that he was not to be there.
On 05/23/2022 Officers were present at district court when BRENNAN was served a PFA (Protection From Abuse Order) (PFA Docket #XXXXXX). The PFA evicts/excludes BRENNAN from the residence at Woodland Road and restricts him from contacting with the homeowner by any means. The PFA was explained to him by his attorney.
On 05/23/2022, at 1400 hours, BRENNAN had a preliminary hearing at District Court regarding the previous incidents regarding trespassing and he was advised by the judge that he was not to contact his ex-wife and to not go to the residence.
On 05/23/2022 at approximately 1711 hours BRENNAN'S vehicle was parked again outside the resident and was unoccupied. Officers approached the front door which had a clear glass window in the center of the door. Officers saw BRENNAN walk past the front door and run towards the back of the home. BRENNAN was discovered again inside the home and was found locked inside his ex-wife’s bedroom. He was again arrested for violating the PFA and trespassing.
CRIMINAL CHARGES, AND ANY DISCUSSION THEREFORE, ARE MERELY ALLEGATIONS AND ALL DEFENDENTS ARE PRESUMED INNOCENT UNTIL AND UNLESS PROVEN GUILTY.
